Subject of the contract
1.1. Within the framework of this agreement, the Client commissions the Psychologist to assist them through counseling in dealing with personal, family, workplace, and other private issues.
1.2. The Psychologist accepts the commission. They inform the Client that within the scope of their counseling activities, they may suggest the frequency and length of the counseling process. The Psychologist also informs the Client that disregarding these recommendations may adversely affect the success of the counseling. The Client acknowledges this information from the Psychologist.
1.3. Service Fee For using the counseling services, the Client is obliged to pay the service fee specified in the Psychologist's Data section above. As a main rule, payment is made in cash per session, with an invoice. The parties may also agree that the Client settles the service fee to the Psychologist in advance via bank transfer or through a subsequent bank transfer.
If the invoice is not issued in the Client’s name, no other information related to the counseling will be provided to the payer beyond the details on the invoice.
In case of payment delay, the Client is obliged to pay late payment interest, which annually amounts to one and a half times the prevailing central bank base rate, but at least 10% per year.
1.4. The contracting parties agree that in-person and/or online counseling can be canceled by the Client free of charge according to the Payment and Cancellation Terms (see 1.6./point 2). If the cancellation is made by the Client beyond the cancellation period specified in point 1.6./2 and mutually accepted, the Psychologist is entitled to issue an invoice for the missed counseling based on the penalty rate found in 1.6./point 3.
In-person and/or online counseling can also be canceled free of charge within the deadlines mentioned above in the following cases: sudden illness, sickness, accident. The number of free cancellations is capped (1.6./point 4).
1.5. At least according to 1.6./point 5 before the appointed time, the Client or the Psychologist is entitled to initiate a change of counseling time either by phone or email. If the parties initiate within this time frame, the cancellation terms apply (1.4.). Subsequently, the contracting parties jointly arrange a new counseling time.

Terms and Conditions
2. Explanation of terms in the contract
2.1. Psychologist: An individual who has obtained a qualification in psychology as a major subject at university – either in full-time, evening, correspondence, or supplementary form – and practices the principles and methods of this science professionally (as a vocation) in practice, education, and research. They can only perform activities for which they possess the proper qualifications and are authorized by law.
2.2. Client: An individual who wishes to use the services of the psychologist, either individually or within the framework of couples therapy.
2.3. Counseling: A service provided by the psychologist to the client as part of the professional activities described in section 2.1, which is not considered a healthcare service.
2.4. Emergency situation: Any fact, circumstance, event, or conspicuous client behavior brought to the psychologist's attention during counseling that requires immediate action for the improvement of the client's condition.
3. The rights and obligations of the contracting parties
3.1. The Psychologist undertakes to act in consultation with the attending physician in the case of a client who is undergoing medical treatment and where the psychologist's activities might impact the medical therapy or vice versa.
3.2. To avoid a dual relationship, the Psychologist shall not establish a psychological client relationship with the client’s
(a) family member, relative, friend, direct colleague, or anyone with whom they have any other close relationship,
(b) anyone who is closely related to another client of theirs.
If, during the contractual relationship, a relationship develops between the contracting parties (friendly, emotional, etc.) that endangers the professional work of the psychologist, the psychologist commits to terminating this contractual relationship by notice.
3.4. At the beginning of the contractual relationship, the psychologist is required to inform the client about their confidentiality obligations and, if justified, to whom their psychological opinion written during the contract must be handed over. They must also inform the client about the purpose, results, and potential consequences of the sessions according to their age, education, psychological state, and whether they can refuse to participate, including the expected consequences of refusal.
3.5. The psychologist is obliged to inform the client or, in the case of a limited-capacity or minor client, their legal representative or parent, about the results of the sessions and the written documents prepared accordingly, in a manner that is unambiguous for them given their condition. Experiences and conclusions gained in the course of their work must be communicated in an understandable way to the client or, in the case of a minor client, to their legal representative or parent.
3.6. The Psychologist informs the client that they can only achieve a positive change in the client's condition if the client fully cooperates with them. The client acknowledges this information.
3.7. The House Rules of the venue for counseling form Appendix 1 of this contract. The client declares that they have understood the provisions of the House Rules and accept them as binding on themselves. They acknowledge that repeated violations of the House Rules may lead to the immediate termination of the contract.
3.8. The psychologist informs the client that during this contractual agreement, they handle the client's personal data and thus qualify as an independent data controller. The psychologist guarantees that the personal data collected or learned during their entrusted activities – particularly sensitive data – are handled lawfully, in full compliance with the mandatory provisions of the General Data Protection Regulation of the European Parliament and Council (EU) 2016/679 ("GDPR"), and takes all necessary technical and organizational measures to ensure the appropriate level of data protection and security. The contracting parties record that the information regarding data management carried out by the psychologist is contained in the data management notice, which forms Appendix 2 of this contract.
3.9. The client declares their acceptance of this contract, stating that they have become familiar with the content of the data management notice and have acknowledged its contents.
4. Duration and termination of the contract
4.1. The contracting parties conclude this mandate contract for an indefinite period, and it becomes effective on the day of acceptance.
4.2. The contracting parties agree that the client may terminate this mandate contract in writing, via email, at any time and without justification with immediate effect. The client and their legal representative acknowledge that immediate termination does not exempt them from any payment obligations due.
4.3. The contracting parties agree that the Psychologist may terminate this mandate contract in writing with immediate effect in the following cases:
a.) with professional justification,
b.) if the client has seriously breached any obligation in this mandate contract.
4.4. In the event of self-harming or dangerous behavior, or suspicion of any such behavior, or if, according to the psychologist's assessment, these could potentially occur during any stage of the counseling process, the psychologist:
4.4.1. Advises the client that individual counseling can only continue if the client seeks psychiatric help alongside psychological counseling.
4.4.2. If the client fails to present the psychologist with an authentic document issued by the psychiatric institute/psychiatrist initiating their psychiatric treatment (including details of the attending doctor/institute) by the latest second session following the advice given in the previous point, the psychologist is entitled to terminate this contract immediately;
4.4.3. Despite the commencement/existence of parallel psychiatric treatment, the psychologist is entitled to the following if they believe the client is not cooperating adequately and the likelihood of self-harming and/or dangerous behavior is high:
a) notifying the emergency contact if provided;
b) informing and notifying the attending psychiatrist/psychiatric institution;
c) informing the professionally justified health authority in case of a substantiated suspicion of danger to self or others;
d) immediate termination of this contract.
5. Other provisions
5.1. During the performance of this contract, the contracting parties are obliged to cooperate mutually, and the contract can only be modified in writing by mutual agreement of the contracting parties.
5.2. In matters not regulated by this contract, the provisions of the Civil Code (Act V of 2013) shall prevail.
